Workers Compensation
Since the firm’s
founding, our primary focus has been defending
employer and carrier interests in Workers’ Compensation
matters. The firm has ten partners and two
associates who are board certified by the Florida
Bar as specialists in this area. We
provide aggressive, thorough representation
in every JCC district in the state, both at
mediation and at trial if mediation is unsuccessful.
Commercial and General Litigation
HR attorneys are involved in many types of commercial and general civil litigation cases, including contract claims, non-competition agreements, employment practices, discrimination, wage and hour, real estate disputes, domestic law issues and can advise and assist in the drafting of contracts, settlement agreements and collection of judgments and debts.
Liability and Casualty Defense
The firm actively defends insured and self insured individuals and corporations in nearly every kind of matter involving liability and casualty defense. HR attorneys defend manufacturers, distributors and retailers in product liability claims. We are actively involved in the defense and prosecution of premises liability claims including sudden falls, business practice negligence, negligent security, liquor liability, and building and municipal code violations. HR advises clients and defends corporations and individuals in all types of intentional tort claims such as intentional infliction of emotional distress, libel and slander, fraud/misrepresentation, assault and battery.
Automobile and Commercial Trucking
Our lawyers have represented individual auto owners, independent operators, rental car companies, leasing companies, corporate fleet operators, underinsured/uninsured motorist carriers, and commercial vehicle owners in practically every type of claim involving motor vehicles. In addition to defending automobile and commercial trucking matters, the firm can handle insurance disputes and matters of coverage involving underinsured/uninsured motorist policies, policy interpretation and evaluation, contractual indemnity and contribution and advises clients in the area of coverage evaluation, contractual obligations/rights and statutory interpretation.
Insurance Coverage Disputes
HR attorneys are active in consulting with clients regarding the interpretation of their insurance policies, their rights and obligations under the contract, and extracontractual liability. The firm represents insurance companies, individuals and corporations in all types of coverage disputes in addition to defending insurers in first party claims and prosecuting breach of contract and declaratory judgment actions.
APPELLATE PRACTICE
Our concentration in
the defense of Workers’ Compensation cases
has created several other areas of practice.
With regard to appeals, our attorneys have handled
hundreds of appellate matters before the First
District Court of Appeal, the Florida Supreme
Court, and the Eleventh Circuit Court of Appeal
in Atlanta. Our experience in appellate matters
has resulted in many landmark decisions in the
area of Workers’ Compensation.
SUBROGATION AND LIABILITY
DEFENSE
HR is educated in the
nuances of lien law and subrogation. We are
experienced in aggressively pursuing maximum
lien recovery and all other subrogation rights.
HR is also proficient in handling coverage “B”
claims on either an hourly or contingency fee
basis.
EMPLOYMENT LAW
Many times in the context
of a Workers’ Compensation claim, separate
causes of action may be asserted against employers
under theories of discrimination, retaliation,
wrongful termination or other claims. In such
instances, we will become familiar with an employer’s
personnel, practices, and procedures, and provide
effective representation.
ADMINISTRATIVE PROCEEDINGS
Outside of Chapter 440,
our attorneys represent employers and other
clients in Administrative matters under Chapter
120. These proceedings require the same careful
attention to detail and concise articulation
of the legal positions and arguments of our
clients. The firm is ready to defend clients
in any matter involving a state agency.
CONSULTATION
HR’s knowledge
of the ever changing landscape of workplace
regulation, Drug Free Workplace and other Managed
Care has allowed us to counsel employers in
crafting internal policies and procedures. Whether
in a seminar setting or individually, employers
